General Product Safety Regulation


In this article, you will find out what the GSPR says, what obligations it imposes on manufacturers and retailers and how we can support you.


The General Product Safety Regulation (GPSR) 2023/988/EU, which will apply from 13.12.2024, replaces the previous General Product Safety Directive (2001/95/EC).


It aims to strengthen product safety in the European Union and adapt it to the current challenges of the digital market and globalized trade.the GPSR lays down binding rules for manufacturers, importers and distributors to ensure that all products placed on the EU market are safe.


The main innovations include:
Consideration of modern technologies:  
Including artificial intelligence, connected devices and other digital innovations.

Strengthening consumer rights:
Improved recall mechanisms and clearer information obligations in the event of safety risks.
Obligations along the supply chain:
Introduction of new responsibilities for all economic operators, including online marketplaces.

Harmonization with other EU legislation:
Closer coordination with existing regulations such as the Market Surveillance Regulation (EU) 2019/1020.
The GPSR creates a uniform framework that promotes both consumer safety and transparency and fairness in trade. Companies should carefully review the new requirements and adapt their processes accordingly to ensure compliance.

Nach der GPSR 2023/988/EU ergeben sich folgende Pflichten für INTOS als Hersteller

Ensuring product safety
Manufacturers must ensure that their products are safe under normal or foreseeable use and do not pose a risk to consumers. In doing so, they must take into account the current state of the art and possible specific risks.

Technical documentation and risk assessment
  • A comprehensive risk assessment covering all potential hazards must be carried out. 
  • Technical documentation must be provided containing information on the design, manufacture and compliance with safety requirements

Labeling requirements
  • Products must be labeled with the name, registered trademark and contact address of the manufacturer. 
  • If required, instructions for use and safety information must be provided in the official language of the EU Member State.
Traceability and recall
  • Manufacturers must ensure that their products can be traced (e.g. by article number/EAN). 
  • Effective procedures must be put in place to deal with unsafe products, including recall measures.

Market surveillance and cooperation with authorities
  • Manufacturers are obliged to inform market surveillance authorities about unsafe products and to take measures to minimize risks. 
  • They must regularly monitor the safety of their products.

Reseller obligations under GPSR 2023/988/EU and how INTOS can support you


As a reseller, you play a central role in ensuring that only compliant and safe products reach consumers. Your obligations complement those of the manufacturer:
Ensuring conformity

Retailers may only sell products that meet the requirements of the GPSR. They must check that:


  • The CE marking is correctly affixed (if applicable).
  • Instructions for use and safety information are included.
  • The marking of the manufacturer and/or importer is present.
Handling unsafe products
Resellers must ensure that unsafe products are not placed on the market. If you become aware of safety problems, you must:

  • Notify the manufacturer or importer immediately. 
  • Inform market surveillance authorities and actively participate in product recalls.
Storage and transportation
Distributors must ensure that the storage and transportation of a product does not compromise compliance with the safety requirements.
Cooperation with market surveillance authorities
Upon request, distributors must provide market surveillance authorities with all information on the supply chain and the origin of the product.
Traceability
Distributors must be able to keep information about their suppliers and to whom the product has been resold for an appropriate period of time.

Joint responsibility of manufacturers and resellers


Both economic operators are responsible for ensuring compliance with the Regulation:
Internal procedures:
Manufacturers and resellers must introduce systems that facilitate the traceability and safety verification of products.

 
Obligations in e-commerce:
The same requirements apply to online sales as to stationary sales. Only products with complete and correct information may be sold.
Cooperation with market surveillance authorities:
Both manufacturers and retailers must actively cooperate with authorities, especially in the case of recalls and safety warnings.

Specification of identification features of the products

For InLine products, you will find EAN codes and article numbers on the product packaging and online in the “Logistical data” and “Technical data” tabs.

You can also obtain this information for automated store connections via the

INTOS Content Center (ICC).
Safety instructions
Safety instructions are part of the product presentation and should help to highlight potential residual risks of products and minimize these as far as possible through their presentation. (For products such as cleaning agents or batteries, we also recommend that you make the relevant safety data sheet available for download “online” in your store)
